Equipment First, LLC owns and operates EquipmentPics.com, an Arizona limited liability company doing business as EquipmentPics.com, and any related websites, mobile applications, software platforms, and online services (collectively, the "Platform"). For purposes of this Privacy Policy, references to "Company," "we," "us," or "our" refer to Equipment First, LLC, together with its affiliated entities, parent companies, subsidiaries, members, managers, directors, officers, investors, employees, agents, contractors, and representatives, including without limitation other platforms operated by Equipment First, LLC under different brands. This Privacy Policy explains how information is collected, used, stored, and disclosed when users access the Platform or utilize services provided through it. By accessing the Platform, creating an account, or submitting content through the Platform, users acknowledge that they have read, understood, and agree to the terms of this Privacy Policy. This Privacy Policy is incorporated by reference into, and should be read together with, our Terms and Conditions, our California Privacy Policy supplement (for California residents), and, if you purchase Featured Placement or a Directory Listing, our Advertising Agreement.
Scope of This Privacy Policy. This Privacy Policy applies only to EquipmentPics.com and its associated applications and services (the "Service"). It does not apply to any other website, product, or platform operated by Equipment First, LLC or its affiliates under a different brand or domain. If you use another Equipment First, LLC platform, that platform's own privacy policy governs your information there. Where you use the Service together with another Equipment First, LLC platform in a manner that integrates or combines those platforms, the privacy policies of each apply concurrently to your combined use, consistent with the Scope provision of our Terms and Conditions. This Privacy Policy controls over the Terms and Conditions, California Privacy Policy, and Advertising Agreement solely on matters specifically concerning the collection, use, and disclosure of personal information; those documents control on all other matters as described in their own conflict provisions.
Platform Services. EquipmentPics.com operates as an online gallery that allows users to view and browse photographs of heavy equipment and construction machinery, and to submit their own photographs for display on the Platform. Browsing the Platform does not require an account. Submitting a photograph, and any associated company name or logo, requires creating a free account, as described below.
User-Submitted Content License. Users may upload photographs and, where they elect to include it, an associated company name or logo, through the Platform ("Submissions"). By submitting content through the Platform, the user grants Company a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to store, host, reproduce, display, distribute, and otherwise use such Submissions, including in Company's advertising, marketing, and promotional materials across any channel, including social media, consistent with the license described in our Terms and Conditions. Users represent and warrant that they own or have the necessary rights to submit such content and that it does not violate the rights of any third party.
Information Collection and Use. Because an account is required to submit content, the Company collects only an email address, a password (stored only in irreversibly hashed form), and, if the user chooses to provide one, a company name or handle. The Company does not build or maintain an extended user profile and does not collect a physical address, phone number, or payment information as part of account creation. When a user submits a photograph, the Company also collects the image file itself, any associated company name or logo, and technical metadata such as the upload timestamp and the IP address the submission came from. This information is used to operate the account, administer the license and warranties described in our Terms and Conditions, respond to copyright or ownership disputes, and send the user Service Notifications regarding their account or Submissions.
Website Tracking, Cookies, and Electronic Monitoring Consent. The Company and its third-party partners use cookies, web beacons, tracking pixels (including social media advertising pixels such as the Meta Pixel, Google Ads/Analytics tags, and the TikTok Pixel), and similar technologies ("Tracking Technologies") to keep users logged in, understand how the Platform is used, and measure and deliver advertising — including advertising featuring Submissions — on social media and other platforms. Tracking Technologies that are strictly necessary to operate the Platform may activate automatically; all other Tracking Technologies do not activate for California visitors until the user provides affirmative consent through the Platform's cookie/tracking preference banner.
Multi-State Recording and Electronic Communications Consent. By accessing or using the Platform, including any cookies, tracking pixels, chat features, or contact forms made available through the Platform, users expressly acknowledge and consent to the monitoring, interception, recording, and retention of related electronic communications and browsing activity by Equipment First, LLC and its affiliates and service providers, to the fullest extent permitted by applicable law, including but not limited to the wiretapping, electronic surveillance, and electronic communications privacy laws of all fifty (50) states, including without limitation California Penal Code §§ 631, 632, and 638.51 (CIPA), the Illinois Eavesdropping Act (720 ILCS 5/14), Florida Statute § 934.03, the Pennsylvania Wiretapping and Electronic Surveillance Control Act (18 Pa. C.S. § 5703), Washington Revised Code § 9.73.030, Maryland Courts and Judicial Proceedings Code § 10-402, Michigan Compiled Laws § 750.539c, Nevada Revised Statutes § 200.620, Oregon Revised Statutes § 165.543, Montana Code Annotated § 45-8-213, and Connecticut General Statutes § 53a-189. As described above, non-essential Tracking Technologies will not activate for California visitors until affirmative consent is given through the cookie/tracking preference banner. Users who do not consent to monitoring and recording in any jurisdiction in which they are located should decline non-essential tracking through that banner or discontinue use of the affected features; continued use of the Platform's chat or contact-form features after notice of this provision constitutes knowing, voluntary, and unambiguous consent by the user.
Account Information. Users who create an account are responsible for maintaining the confidentiality of their login credentials and for all activity conducted under their account. Creating an account is required in order to submit content to the Platform.
Contest and Prize Fulfillment Information. If you win a Contest offered through the Service that includes a physical prize, as described in our Terms and Conditions, we may separately collect additional information reasonably necessary to award that prize, such as a shipping address and, where required by law, taxpayer identification information. This information is collected only from Contest winners, is used solely for prize fulfillment and any associated tax reporting, and does not change the minimal information described above that we collect from users generally.
Log Data and Device Information. Like many online platforms, the Company may collect certain technical information automatically when users access the Platform. This information may include internet protocol addresses, browser type, browser version, device type, operating system, pages visited, time and date of visits, duration of activity, and referring websites. Such information may be used for analytics, system monitoring, platform improvement, and security purposes.
Sharing of Information. The Company does not sell a user's account email or password to third parties. Information collected through the Platform may be shared with: (i) service providers that assist in operating the Platform, including hosting providers, analytics services, and customer support providers; (ii) advertising and social media platforms such as Meta, Google, and TikTok, in connection with the Tracking Technologies and advertising described above and the license described in our Terms and Conditions; and (iii) third parties when required by law, legal process, government request, or when necessary to protect the rights, property, or safety of the Company or other users, including in response to a valid copyright or trademark claim.
Security of Information. The Company utilizes commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, or misuse, including password hashing and encryption in transit. However, no method of electronic transmission or internet storage is completely secure, and the Company cannot guarantee absolute security.
Children's Privacy. The Platform is not intended for use by individuals under the age of eighteen (18). The Company does not knowingly collect personal information from minors. If the Company becomes aware that a minor has submitted personal information through the Platform without appropriate consent, reasonable efforts will be made to remove such information.
Third-Party Websites. The Platform may contain links to third-party websites or services that are not owned or controlled by the Company. The Company is not responsible for the privacy practices, policies, or content of such third-party websites. Users should review the privacy policies of any external websites they visit.
Changes to This Privacy Policy. The Company reserves the right to update or modify this Privacy Policy at any time. Any changes will become effective immediately upon posting to the Platform. Continued use of the Platform following such modifications constitutes acceptance of the revised Privacy Policy. This Privacy Policy is effective as of August 1, 2026.
Severability. If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect.
