This CALIFORNIA PRIVACY POLICY supplements Equipment First, LLC's ("Company") Privacy Policy for EquipmentPics.com and applies to all users and visitors of EquipmentPics.com (the "Service") who reside in the State of California. It is incorporated by reference into, and should be read together with, our Privacy Policy, our Terms and Conditions, and, if you purchase Featured Placement or a Directory Listing, our Advertising Agreement. This notice complies with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the "CCPA"), which provides certain rights and specific notification information to California residents regarding data collection, use, and disclosure practices.
Categories of Personal Information. We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly with a particular consumer or device. Sources of Personal Information. We obtain the categories of personal information listed above from the following sources:
Directly from you when you create an account or submit a photograph through the Service.
Automatically through cookies, tracking pixels, and similar technologies when you browse the Service, as described in our Privacy Policy.
From third-party advertising and analytics platforms (such as Meta, Google, and TikTok) in connection with the Tracking Technologies described in our Privacy Policy.
Use of Personal Information. We do not sell the personal information we collect for money; however, as described below, certain sharing of information with advertising and analytics partners may qualify as a "sale" or "share" under the CCPA's broad definitions. We will not collect any additional categories of personal information or use the personal information we collect for purposes materially different from those described in this notice without providing you notice. To display your Submissions, and any associated company name or logo, in our advertising, marketing, and promotional materials, including on social media.

B. Right to Opt-Out of Sale / Sharing. You have a right to instruct the Company and its affiliates not to sell or share your personal information, including for cross-context behavioral advertising. C. Right to Correct. You have the right under the CCPA to correct inaccuracies in the personal information we have about you. We will use commercially reasonable efforts to correct any inaccuracies you identify, considering the nature of the information and the purpose of its use.
D. Right to Delete. You have a right to request that your personal information be deleted, subject to certain exceptions. Once we receive a formal deletion request, we will delete your personal information and instruct our service providers and contractors to do the same, unless retention is necessary to:

Exercising Your Rights. To exercise any of your rights under the CCPA, you may submit a request by emailing us at info@equipmentfirst.com. Only you, or a person registered with the California Secretary of State that you have authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may make a verifiable consumer request for access or data portability no more than twice within a 12-month period. The request must provide sufficient information to allow us to reasonably verify you are the person about whom we collected the information, or an authorized representative, and must describe your request with enough detail for us to properly understand, evaluate, and respond to it.
Response Timing and Format. We endeavor to respond to a verifiable consumer request within 45 days of receipt. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response through your account; otherwise, we will deliver it by email. Any disclosures we provide will cover only the 12-month period preceding the request. Our response will explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will provide your personal information in a format that is readily usable and allows you to transmit it to another entity without hindrance. We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded, in which case we will explain why and provide a cost estimate before completing the request.
Electronic Communications, Social Media, and California Wiretapping Compliance. By accessing or using the Service, including any cookies, tracking pixels, chat features, contact forms, social media integrations, or third-party social media plug-ins embedded in or linked to the Service, California residents expressly acknowledge and consent, pursuant to the California Invasion of Privacy Act (California Penal Code §§ 631, 632, and 638.51) ("CIPA"), that Equipment First, LLC and its affiliated entities may monitor, record, store, and analyze electronic communications and browsing activity transmitted through or in connection with the Service, including communications facilitated through or originating from social media platforms, third-party messaging integrations, or embedded communication tools, for lawful business purposes including quality assurance, fraud prevention, legal compliance, dispute resolution, and platform security. Consistent with our Privacy Policy, non-essential Tracking Technologies do not activate for California visitors until affirmative consent is given through the Service's cookie/tracking preference banner. Users who do not consent to such monitoring and recording should decline non-essential tracking through that banner or discontinue use of the Service's chat or contact-form features.
Severability. If any provision of this California Privacy Policy is held to be invalid, illegal, or unenforceable under applicable law, including the CCPA, such provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force and effect.
Changes to This Privacy Policy. This California Privacy Policy is effective as of August 1, 2026, and will remain in effect except with respect to any future changes, which will take effect immediately upon posting to the Service. We reserve the right to update or change this notice at any time, and you should check it periodically for updates.
